Welcome to Ember Grove ("the App"), a cozy game provided by Phantom Labs ("we," "us"). These Terms of Use ("Terms") govern your use of the App. By downloading, installing, or using Ember Grove, you agree to these Terms.
Ember Grove is a mobile game that turns your real-world activity — steps, sleep, and workouts read from Apple Health — into energy for a virtual garden. The App is designed for personal entertainment and wellness motivation.
Ember Grove reads health data from Apple Health (HealthKit) solely to award in-game sunlight. This data is processed entirely on your device, is read-only, and is never transmitted to us or any third party. You can revoke health data access at any time in iOS Settings without losing your game progress.
Grove Pass. An optional subscription or one-time purchase that removes all advertisements from the App. Details and pricing are displayed in the App before purchase.
Billing. All purchases are processed by Apple through the App Store. Payments are charged to your Apple ID. If the Grove Pass is offered as a subscription, it will automatically renew unless cancelled at least 24 hours before the end of the current period.
Cancellation. You can cancel any subscription at any time in iOS Settings → [your name] → Subscriptions. Cancellation stops future renewals; access continues until the end of the current paid period. Refunds are handled by Apple under their applicable refund policy.
The free version of Ember Grove displays non-personalized ads served by Google AdMob at natural pauses in gameplay. Subscribing to the Grove Pass removes all ads. Your health data is never shared with any advertising service.
We grant you a limited, non-exclusive, non-transferable license to install and use Ember Grove on Apple devices you own or control, for personal, non-commercial purposes, subject to these Terms and the Apple App Store Terms of Service.

All artwork, animations, text, and game mechanics in Ember Grove are the property of Phantom Labs. Game balance, features, and content may change with updates.
Your use of the App is also governed by our Privacy Policy, which describes how Ember Grove handles data on your device, advertising, and Apple purchases.
We may update, modify, or discontinue the App or any feature at any time. We may release new versions through the App Store; you may be required to update to a current version to keep using Ember Grove.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
EMBER GROVE IS NOT A MEDICAL DEVICE OR HEALTH SERVICE. THE APP READS HEALTH DATA FOR ENTERTAINMENT PURPOSES ONLY AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSES, OR TREATMENT RECOMMENDATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHANTOM LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Ember Grove does not collect personal data from anyone, including children. The App can be used by anyone subject to Apple's age gates and these Terms. Ads displayed in the free version are always non-personalized.
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by uninstalling it.
These Terms are between you and Phantom Labs — not Apple. Apple is not responsible for the App or its content. Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Denver County, Colorado.
We may update these Terms from time to time. Material changes will be communicated in the App. Continued use after changes take effect constitutes acceptance of the revised Terms.
